OUT OF CTRL operates this website and online store, including the information, content, features, products, tools and services made available through it (collectively, the “Services”).
Our store is powered by Shopify, which provides the ecommerce platform that enables us to offer our products and Services to you.
These Terms of Service, together with our Privacy Policy, Refund Policy, Shipping Policy and any other policies referenced on our website, govern your use of the Services.
By accessing our website, creating an account, placing an order or otherwise using the Services, you agree to these Terms of Service and our applicable policies.

SECTION 3 — ORDERS
When you submit an order through OUT OF CTRL, you are making an offer to purchase the products in your order.
Receiving an automated order confirmation does not necessarily mean that we have accepted your order.
We reserve the right to refuse or cancel an order where reasonably necessary, including where:
- a product is unavailable;
- incorrect pricing or product information has been displayed;
- we cannot authorize or verify payment;
- we reasonably suspect fraud or unauthorized activity;
- shipping to the supplied address is unavailable; or
- accepting the order would violate applicable law.
If we cancel an order after payment has been received, we will refund the applicable amount to your original payment method.
Please review your order carefully before submitting it.

We cannot guarantee that an order can be changed or cancelled once processing or fulfilment has begun.
Purchases are also subject to our Refund Policy and any mandatory consumer rights applicable to you.
SECTION 4 — PRICES AND PAYMENT
Prices displayed on our website are shown in the currency selected or made available to you through our store.
Prices, promotions and discounts may change without notice.
The price applicable to your purchase will be displayed during checkout before you submit your order.
Any applicable shipping charges, taxes, duties or other charges that we collect will also be displayed during checkout where supported and applicable.
International orders may potentially be subject to additional taxes, customs duties, import charges or carrier fees depending on the destination, applicable law and fulfilment method.
Where such charges are not collected by us at checkout, they may be payable separately by the recipient where permitted by applicable law.
You are responsible for providing complete and accurate billing and payment information.
Payments are processed using payment providers available through our Shopify store. We do not directly store your complete payment-card details.
SECTION 5 — SHIPPING AND DELIVERY
We offer shipping to the destinations displayed as available during checkout.
Delivery estimates shown on our website or during checkout are estimates and not guaranteed delivery dates.
Orders may be fulfilled and shipped by third-party fulfilment partners and suppliers.
As a result, products within the same order may occasionally be processed or delivered separately.
Shipping times may be affected by circumstances outside our reasonable control, including carrier delays, customs processing, severe weather, public holidays and other logistical disruptions.
We will provide tracking information where tracking is available for your order.

Nothing in this section limits rights or remedies available to consumers under applicable law in relation to delivery.
SECTION 6 — RETURNS AND REFUNDS
Returns, refunds and exchanges are governed by our Refund Policy.
OUT OF CTRL currently provides a voluntary 30-day return period, subject to the eligibility requirements and exclusions described in that policy.
This voluntary policy is additional to, and does not replace or restrict, statutory consumer rights that may apply to your purchase.
Customers in Ireland, the European Union and other applicable jurisdictions may have additional statutory cancellation, conformity, repair, replacement, price-reduction or refund rights.

SECTION 7 — PROMOTIONS AND DISCOUNT CODES
We may occasionally offer discount codes, sales, promotional offers or other incentives.
Promotions may be subject to additional conditions communicated at the time of the promotion.
Unless otherwise stated, promotional codes cannot be exchanged for cash and may not be combined with other offers.
We reserve the right to modify or withdraw a promotion where reasonably necessary, subject to applicable law and without affecting orders already validly completed under that promotion.

The OUT OF CTRL name, logo and original brand assets may not be used in a way that falsely suggests endorsement, affiliation or authorization by OUT OF CTRL.

Our Services may include functionality, content or links provided by third parties.
This may include payment processors, shipping carriers, fulfilment providers, analytics providers, social-media platforms and other ecommerce services.
We are not responsible for the content or operation of independent third-party websites.

SECTION 10 — RELATIONSHIP WITH SHOPIFY
OUT OF CTRL is powered by Shopify, which enables us to provide the Services to you.
However, purchases made through our store are transactions between you and OUT OF CTRL, not between you and Shopify.
Shopify provides the ecommerce infrastructure used to operate our store but is not the seller of the products offered by OUT OF CTRL.

SECTION 11 — PRIVACY AND PERSONAL INFORMATION
Your privacy is important to us.

Nothing in this section applies in a manner that would remove or restrict mandatory consumer protections.
